A member letter against SB236

Dear legislators,

Although I am in Maryland, I am a proud, involved, Louisiana Dad, who has had to go to court to fight for every single day of parenting time for my daughter held hostage in South Louisiana. She was kidnapped by her mother who was too proud (or too sick) to believe the many diagnosis of Bipolar, refused to get help, and shopped for jurisdiction in South Louisiana because she found out judges ignore the loosely written legislation that provides too many holes to avoid any reasonable shared parenting. My little girl never had a chance...neither did her 3 siblings from who she was stripped away from, who would like to know their sister.

As I got involved in support groups promoting shared parenting, and personally interacted with the Nation's top experts on Parental Alienation, it became painfully obvious that Louisiana is moving backwards, while most other states are making progress toward equal shared parenting. EVERY child NEEDS both parents...at least to start. I am now an ordained minister and expert on child abuse, parental alienation, and the reasons some parents become alienating and abusive (there are certain scenarios of childhood abuse prevalent in certain areas of South Louisiana, and pockets throughout other states). There is no cure...only treatment. And the children of divorce need every bit of help they can get following such a traumatic event such as divorce--that is to start off with equal time with both parents (preferably ordered to remain close enough to the other parent so as to be able to remain involved), which will help curtail the inevitable tug of war, attempted alienation, and harmful control struggle inherent in a parent being designated "primary" custodian.

SB236--changing the little word "should" to "may" is all the ammo judges need to fleece more dads, and create more broken homes in the state that already has the second HIGHEST rate of single-parent homes. Kids don't have a chance in your state--THEY NEED BOTH PARENTS (usually it's the dad who is deprived of their parental rights to care and companionship of his children--rights so fundamental as to be guaranteed protection under the First, Ninth, and Fourteenth Amendments of the United States Constitution, but a few moms fall into it, as well). Please KILL SB236, (and move forward Rep Harrison's equal shared parenting Bill, while you're at it...for the children!).Professor Spaht has sought to keep dads out of their children's lives for decades now.

She was there in 1993, trying to strangle this law in its cradle.

She was there in 1995, trying to neuter this law.

She was there every year since, plotting, scheming, and assiduously working to keep us out of our children's lives.

She was there in 2001, trying to take the self support reserve out of the law, trying to keep worksheet B from being born, trying to limit its use and ensuring that child support orders could exceed 100% of a person's income.

She was there in 2005 before Katrina, trying to throttle Worksheet B, and there again in 2006 after Katrina, trying to strangle it while most of us were still rebuilding.

She was there in countless of other measures, seeking to indenture, enslave, limit, and throttle our involvement in our children's lives.

THIS CAN HAPPEN TO YOU, or your children who have children...and it's not really just dad's getting forced out of our children's lives...it occasionally happens to a mom. Please feel free to use my message as testimony against SB236, allow me to speak out over the phone...anything to help--I cannot be there in person, as I am home in Maryland with my little girl, who is finally home from Louisiana, on one of the precious days I had to fight so hard to get (which I never should have had to fight for since even your Supreme Court ruled interpretation of "legislative intent" was for equal, shared parenting). Please do not set Louisiana any further backwards for the children who cannot escape.

Respectfully submitted,

Ken

--

Ken (redacted)
(address redacted)

Committee votes to allow judges to act against a childs best interest

Under current law, when a parent is awarded joint custody, the judge has a two pronged test to apply.

1) If it is practical
2) If it is in the child's best interest

Then custody of the child should be awarded equally.

Yesterday, the House Civil Law and Procedure Committee voted to change this law.

The new law reads.

1) If it is practical
2) If it is in the child's best interest

Then custody of the child may be awarded equally.

So in essense the committee is saying that the judge no longer has to act in the child's best interest.

A judge that has determined that it is both practical and in the child's best interest to have equal time with both of his parents no longer has to implement such an order.

The judge can instead choose to act against the child's best interest.

Worksheet B Application

The economists (PSI - Dr. Venohr) who designed Louisiana's Child Support Tables, from day one to the present time, intended for Worksheet B to be used any time a parent had over 102 overnights (28% time) with their child.

There are three general classes of custody: Shared Parenting; Joint Custody; Sole Custody

Shared Parenting: This class should constitute 80% of all divorced parents. Most parents are fit, caring, loving parents. These parents should have essentially equal parenting time with their children. Each parent should have a minimum of 102 overnights with their children. Most of the cases should be close to 50/50 with the group tailing off significantly by the 102 overnight limit. For these cases, Worksheet B should be used.

Joint Custody: This class should consist of 16% of all cases. In this class, both parents retain decision making authority for their children, however, due to family circumstances, usually living too far apart, shared custody is unworkable. The non-domiciliary parent should have between 73 and 102 overnights with their children. For these cases, Worksheet A with a Joint Custody Credit, should be used.

Sole Custody: This class should consist of 4% of all cases. In this class, one parent has been proven unfit. That parent has lost their custody rights. The non-custodial parent should have between 0 and 73 overnights with their children. Most of the cases should be close to 0 overnights with the group tailing off significantly by the 73 overnight limit.
